1. Acceptance of Terms
By accessing or using My Other Order ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
My Other Order provides a cloud-based catering management platform that enables restaurants to:
- Manage catering orders and proposals
- Sync menus with point-of-sale systems
- Process customer orders and payments
- Coordinate kitchen operations and prep schedules
3. User Accounts
Account Creation: You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.
Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.
Account Termination: We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
4. Data Ownership and Usage
Your Data: You retain all rights to the data you input into the Service, including customer information, orders, and menu items.

5. Payment Terms

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY OTHER ORDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from the Service
- Any bugs, viruses, or other harmful code transmitted through the Service
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
10. Indemnification
You agree to indemnify, defend, and hold harmless My Other Order and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other rights of any third party.
11. Service Availability
We strive to provide 99.9% uptime but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
13. Termination
By You: You may terminate your account at any time by contacting us at security@myotherorder.com.
By Us: We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms or for any other reason at our sole discretion.
Effect of Termination: Upon termination, your right to use the Service will immediately cease. We may delete your data after a 30-day grace period unless required by law to retain it.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of New York.
15. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Other Order regarding the use of the Service and supersede all prior agreements and understandings.
